WAIVER AND RELEASE OF LIABILITY AND ASSUMPTION OF RISK
AND PARENTAL CONSENT AND INDEMNITY AGREEMENT:
READ WAIVER STATEMENT BEFORE SIGNING. If a player is 17 years of age or younger, the parent / guardian must sign their name and date this team form. READ WAIVER & RELEASE OF LIABILITY & ASSUMPTION OF RISK & INDEMNITY AGREEMENT BEFORE SIGNING. In consideration of myself or my minor child being allowed to participate in any way in any TORHS 2Hot4Ice Activity ("Activity"), I agree and acknowledge:
1. I understand the nature of TORHS 2Hot4Ice Activities and acknowledge my and/or the Minor's experience and capabilities and believe myself and/or the Minor to be qualified to participate in such activity. I further acknowledge that I and/or the Minor are aware that the activity will be conducted in facilities open to the public during the activity. I further agree and warrant and will instruct the Minor that if, at any time, the Minor or I believe conditions to be unsafe, he/she will immediately discontinue further participation in the activity. I agree and warrant that if, at any time, I believe conditions to be unsafe, I will immediately discontinue further participation in the activity.
2. I FULLY UNDERSTAND that: (a) TORHS 2Hot4Ice Activities involve risks and dangers of SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS and DEATH ("risks"); (b) these risks and dangers may be caused by my/or the minor's own actions, or inaction's, the actions or inaction's of others participating in the activity, the condition in which the activity takes place or THE NEGLIGENCE OF THE "RELEASES" NAMED BELOW; (c) there may be other risks and social and economic loses either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITIES FOR THE LOSSES, COSTS, AND DAMAGES incurred as a result of my and/or the Minor's participation in the activity.
3. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO HOLD HARMLESS TORHS 2Hot4Ice, their respective administrators, directors, agents, officers, volunteers, and employees, and other participants, any sponsors, advertisers, and if applicable, owners and lessors of the premises on which the activity takes place (each considered one of the "releases" herein) from all liability, claims, demands, loses, or damages on account caused or alleged to be caused in whole or in part by the negligence of the "releases" or other otherwise, including negligent rescue operations and further agree that if, despite this release, I and/or the Minor, or anyone on my and/or the Minor's behalf makes a claim against any of the releases named above, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS EACH OF THE RELEASES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE OF COST AS MAY INCUR AS THE RESULT OF ANY SUCH CLAIM. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AND/OR THE MINOR HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY THE LAW AND AGREE THAT IF AN
PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THAT THE BALANCE NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
4. Before participating in any activity or event operated by TORHS 2Hot4Ice and/or its member leagues or clubs, I/We agree to abide by the rules of TORHS 2Hot4Ice as currently published. I/We fully understand and appreciate that participation or observation of TORHS 2Hot4Ice Activities involves risk and dangers of serious bodily injury, including permanent disability, paralysis and death. I/We voluntarily and knowingly recognize, accept and assume this risk and otherwise agree to hold harmless TORHS 2Hot4Ice, LLC, its affiliates, sponsors, event organizers, member clubs and leagues, and officials from any liability arising there from.
5. I also irrevocably authorize TORHS 2Hot4Ice and any licensee or assignee to use my name and or likeness, without compensation, in photography, video or any other format for publication, sale, production, advertising in connection therewith, or any other use.
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND IT'S TERMS, UNDERSTAND THAT I / THE MINOR HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY THE LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THAT THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
ADDENDUM TO WAIVER AND RELEASE OF LIABILITY AND ASSUMPTION OF RISK
AND PARENTAL CONSENT AND INDEMNITY AGREEMENT:
As an Addendum to the Waiver you have previously signed with us, you agree and understand the following:
By participating in ANY TORHS 2HOT4ICE (OR TORHS HOCKEY) EVENT, you are aware that you agree to fully accept all known and unknown risks, including the potential risk of exposure to respiratory illnesses such as the coronavirus (COVID-19). The coronavirus is primarily transmitted via exhaled respiratory droplets, most often through coughing and sneezing. These droplets can travel up to six feet and are more commonly transmitted between persons rather than from equipment to persons.
Although we are taking extra precaution to regularly sanitize common touchpoints and presently are using enhanced cleaning methods and enforcing social distancing in the facility, you understand that you may be exposed to the coronavirus or its symptoms through no fault of our own. Known coronavirus symptoms include fever, coughing, shortness of breath, pneumonia, kidney failure, and may include other symptoms, stroke or even death (collectively "Symptoms"). You understand and agree that you will hold us harmless and you will not hold us liable for any real or perceived Symptoms of COVID-19 or any other disease, illness, or condition, nor for exacerbating any existing symptoms, and you fully agree to accept all risks of entering the facility, using any of the facilities amenities, competing in any tournament games or activities, and/or interacting or being exposed to other facility patrons.
